Will of Joseph Marlatt
In the name of the Benevolent Father of all, I, Joseph Marlatt of thi
County of Highland and State of Ohio do make this my last will and
testament.
Item I I do give and bequeth to my granddaughter Clarinda Marlatt my Bed
Redsliad and bedding.
Item 2 I also give and bequeath my mantle clock to Ohio Cox my grand
daughter
Item 3 I also give to my granddaughter Missouri Cox my patch quilt.
Item 4 I also give to my grand daughter Matilda Cox my little Trunk.
Item 5 Do also give and bequeath to each of my surviving heirs with the
exception of Martha Cox and Daniel Marlatt the sum of one dollar each.
Item 7 The Balance of my personable property to be disposed of as by my
Executor according to law.
Itme 8 My real estate I do give and divise to my beloved daughter Martha
Cos during her natural life time and at her death to go to my son, Daniel
Marlatt after all debts are paid.
I do herby nominate Reuben McClure Executor of this my last will and
testament hereby authorizing and empowering him to compromise, adjust,
relase and discharge in such manner he may deem proper the debts and
claims due me. I do also authorize and impower him if it shall become
necessary in order to pay my debts to sell my private sale or in such
manner or terms of credit on other deeds to purchasers to execute
acknowledge and deliver in fee siple I devise that no appraryment and ors
sale of my personal property for ???? that the Court of Probate direct
the omition of the same ?????? the statule. I do hereby revoke all
former will by me made in leslim my hereof I have set my hand and seal
this 16th day of January 1862.
Signed and acknoledged by said Joseph Marlatt as his last will and
testament in our presents and signed by us in his presents

The State of Ohio, Highland County S.S.
This day the last will and testament of Joseph Marlatt late of Highland
County Ohio deceased was produced me Court. Whereupon cause personally
Heugh J. Heuhanngton and William P. Stiwart subscribing witnesses hereto
who bring first duldy sworn dispose and say that Joseph Marlatt at the
time of executing and publishing said last will and testement which is
writton on this sheet of paper was over the age of twenty one years of
sound mind and memory and not under any restriant that he voluntially
subscribed said last will and testament by affixing his word thereto and
ni their presence and hearing published and declared this same to be his
last will and testament and that they ni his presence and at his request
signed the same as subscribing witnesses thereto and in the presence of
each other.
